Terms & Conditions

HOUSE RULES

1. No towels, bed linen or other items listed on the Property inventory may be removed from the Property, or damaged.

2. Pets to be allowed under the responsibilities of the guest in case of any damages.

3. Vehicles may only be parked in designated areas and not on the street. Consideration must be shown to neighbors when parking. Any vehicles parked in contravention of this provision may be towed away and/or a fine may be levied against the owner.

THIRD PARTY SERVICE PROVIDERS

1. Luxury Explorers’ Collection may facilitate the provision of third-party services (including, for example, housekeeping, laundry, limousine transfer, luggage transfer, holiday tours and excursions, beauty and SPA, land line telephone, broadband internet, cable TV and/or food delivery or catering services), in each case, by third party service providers. Luxury Explorers’ Collection is not an agent of any such third-party service providers and is not in any way responsible for third party service providers or the quality, availability, dysfunctionality or suspension of any of the services provided. The Guest must comply with the terms and conditions including payment terms of the relevant service provider. Luxury Explorers’ Collection will use its reasonable efforts to communicate any written complaints raised by a Guest in connection with any such services to, and procure that, any such service provider addresses such complaint.

INTERPRETATION

In this Agreement:

AED means United Arab Emirates Dirhams.

Guest Occupancy Agreement means the agreement between Luxury Explorers Vacation Homes Rental LLC and the Guest outlined in the Check-in Form, Booking Confirmation, the key terms mentioned, and these terms and conditions.

Booking Confirmation means the confirmation of the booking received by the Guest at the time the booking was made, or, where no such confirmation exists, or the booking confirmation does not specify the matter concerned, the Letter.

Communal Areas means any communal areas of the community in which the Property is situated to which the Guest has access.

Community Rules means the rules, regulations, policies and procedures established by or on behalf of the Owner applicable to all persons (including the Guest Party) entering or using the Property…

DTCM means the Dubai Department of Tourism and Commerce Marketing.

Luxury Explorers’ Collection means Luxury Explorers Vacation Homes Rental LLC, a holiday home operator registered in Dubai operating under DTCM license number 892287, of F01-23 CBD Maktoum Branch Bldg., Al Khabeesi, Dubai, United Arab Emirates.

GRO means the guest relations officer set out in the Booking Confirmation.

Guest means the person to whom the Booking Confirmation is addressed.

Owner means the owner of the Property, who has appointed Luxury Explorers’ Collection to manage and operate the Property…

Property means the DTCM licensed holiday home which is defined in the Booking Confirmation, or any alternative property provided for the use of the Guest by Luxury Explorers’ Collection.

2. In this Agreement, references to a party to this Agreement include references to the successors or assignee (immediate or otherwise) of that party; and (b) the words “include” or “including” shall mean “including without limitation”.

3. The headings in this Agreement do not affect its interpretation. If there is any conflict or inconsistency between a term in the Booking Confirmation, the key terms and these terms and conditions, the term in the Booking Confirmation shall prevail to the extent of the conflict or inconsistency.

4. If there is any conflict or inconsistency between a term in the Booking Confirmation and the Agreement, the term in the Booking Confirmation shall prevail to the extent of the conflict or inconsistency.

GUEST RESPONSIBILITY

The Guest acknowledges that it has been provided with, and read and understood, the Community Rules. The Guest shall ensure that the Guest Party and all visitors comply with this Agreement and all Community Rules. The Guest shall be liable for and hereby indemnifies Luxury Explorers’ Collection, its affiliates, employees, directors, agents, the Owner of the Property and the owners and occupiers of all nearby properties and the Communal Areas on demand (and without the requirement to obtain any court judgement, order or notice or arbitral award) in respect of any costs, losses, damages, claims, proceedings and fees (including legal fees) arising, directly or indirectly, out of or in connection with:

a breach of this Agreement.

a breach of, or non-compliance with, the Community Rules.

the use of the Property and the Communal Areas

the commission of any crime or misconduct by the Guest Party and any visitors.

2. The Guest must report any discrepancies in the inventory provided at check-in immediately following check- in, failing which the inventory shall be deemed accepted by the Guest. The Guest shall be liable for the full costs of rectifying any damage or alteration to the Property and its contents and the Communal Areas howsoever arising during the Guest’s stay at the Property. Luxury Explorers’ Collection may at its discretion charge the Guest an additional cleaning fee in the event that the Property is left excessively untidy or dirty at the end of the stay.

3. The Guest shall (and shall ensure that the Guest Party and all its visitors shall), during the term of this Agreement and at any time it or they use(s) or occupy(s) the Property:

comply with this Agreement and the Community Rules

not do anything which may cause Luxury Explorers’ Collection or the Owner to breach any applicable law or any Community Rules

not make any alteration, improvement or additional whatsoever to the Property or the building in which the Property is located

not display any signs, advertisements, notices poles or flags outside the Property, in the Communal Areas, in the building where the Property is located or elsewhere in the development where the Property is located

comply with all instructions or notices given by the Owner in connection with the use of the Property from time to time; and/or

save for normal wear and tear that may arise from reasonable use of the Property pursuant to this Agreement, not (directly or indirectly) cause any damage whatsoever to the Property or vandalize, destroy, ruin or damage the furniture, walls, painting, floors, household appliances, air condition units, doors, windows, fixtures, closets, bathrooms, towels,bed linens or any other items contained in the Property on the check in date.

CANCELLATIONS AND TRANSFERS

If the booking is cancelled up to 30 days before arrival, no fee will be charged and 100% refundable.

If the booking is cancelled up to 15 days before arrival, 50% of the total amount will be charged.

If the booking is cancelled less than 15 days before arrival, 100% of the total amount will be charged.

Full payment should be received to secure booking.

Security deposit should be paid maximum upon arrival.

SERVICE PROVIDED

Maintenance support unless the main cause of damage and any loss are made by the Guest.

For villas booking: Daily chef services, butler services and housekeeping services for 09-hours per day.

For apartments: Daily housekeeping only.

COMPLAINTS AND ISSUES

1. The Guest shall report any issues with the Property, damage or breakages, or complaints from neighbors to Luxury Explorers’ Collection immediately. Luxury Explorers’ Collection shall not be liable for any issues not immediately reported. Luxury Explorers’ Collection shall investigate and respond to complaints in a timely manner.

2. Luxury Explorers’ Collection liability for injury or death caused by gross negligence, is limited to the amount of the daily occupancy charge only.

3. In the event the Property is unavailable for use for any reason, Luxury Explorers’ Collection may provide the Guest with a similar property without incurring liability from the Guest

4. The Guest will be provided with keys and access cards for the Property at check in as mentioned in the Guest Occupancy Agreement. Any loss and/or damage to the keys/access card(s) will attract a damage fee which may be deducted from the security deposit.

COMPLAINTS AND ISSUES

The Guest shall communicate solely with Luxury Explorers’ Collection personnel in-respect to his stay in the Property and shall not seek to communicate directly with the owner of the Property or make any separate arrangements with the owner of the Property, including for an extension of the stay or a later stay. In the event the Guest breaches this provision, Luxury Explorers’ Collection may keep the Deposit in its entirety and terminate the Guest’s stay early.

CURRENCY AND BANK CHARGES

1. All payments due pursuant to this agreement shall be in AED. If making payments by bank transfer the Guest is responsible for all bank charges and must ensure the amount received by Luxury Explorers’ Collection is the full amount quoted in AED.

EXTENSIONS TO STAY

Any extension of the Guest’s stay shall be subject to availability and pursuant to a separate Occupancy Agreement and may be at a different daily rate to that set out in this Agreement. The Guest must pay the amount due in respect of the extended stay by the date or dates advised by Luxury Explorers’ Collection; in the event the Guest fails to do so, Luxury Explorers’ Collection may remove the Guest Party and any belongings from the Property. Luxury Explorers’ Collection may dispose of such belongings as it sees fit if not claimed within 7 days of such removal, without liability to the Guest or the owner of the belongings.

SECURITY DEPOSIT

The Security Deposit may be paid by credit card, and/ or cash in AED. After 48 hours following check out, Luxury Explorers’ Collection shall return the Security Deposit to the Guest by the method by which the Security Deposit was paid, or, in the event the Deposit was paid in cash, to the bank account notified by the Guest, subject to the deduction of any amounts due to Luxury Explorers’ Collection for any loss or damage to the property or belongings. Security Deposit will be returned in AED and Luxury Explorers’ Collection is not responsible for any decrease in the amount returned to the Guest because of currency fluctuations or bank transfer charges.

TERMS OF PAYMENT

If any payment is made through Cheque, the validity of this Agreement will be subject to the clearance of the cheques.

Should any part of the payment be returned from the bank for insufficient funds or any possible reason, then a penalty of AED1,000.00 for each returned cheque will be charged to the Guest and alternative means of payment must be provided within three days thereof. Failure to supply the due payment will be treated as a breach of the contract by the Guest. The Guest faces immediate eviction and can be reported to the local authorities.

AMENDMENTS TO AGREEMENT

This Agreement may only be amended in writing with the signature (in hard copy or electronically) of an authorized representative of Luxury Explorers’ Collection.

E-SIGNATURE

This Agreement may be signed in hard copy or electronically. By making payment pursuant to this Agreement the Guest agrees to be bound by the terms of the Booking Confirmation, the key terms and these terms and conditions even if this Agreement is not signed.

DATA PROTECTION / PRIVACY

The Guest hereby consents to Luxury Explorers’ Collection, the Owner or any of their respective affiliates, to:

hold and process data relating to the Guest Party or any visitors in the Property to the Guest Party (collectively, the Relevant Persons) for legal, operational, administrative and management purposes and in particular to the processing of any “sensitive personal data or information” as defined in any applicable data protection or privacy legislation relating to the Relevant Persons to the extent permitted by such laws; and

make such information available to other companies in their respective groups, or to those who provide products or services to Luxury Explorers’ Collection (such as suppliers), regulatory authorities, governmental or quasi- governmental organizations;

transfer of such information to Luxury Explorers’ Collection business contacts outside the United Arab Emirates.

GOVERNING LAW AND DISPUTES

Luxury Explorers Vacation Homes Rental LLC is a DCTM Holiday Home Operator. The occupancy of the Property is subject to DTCM regulations and Luxury Collections by Luxury Explorers, and the Guests shall abide by such regulations.

This Agreement shall be governed by and construed in accordance with the laws applicable in the Emirate of Dubai. Any dispute arising out of or in connection with this Agreement, including as to its existence or validity, shall be finally settled by arbitration in accordance with the Rules of Arbitration of the DIFC-LCIA, by a sole arbitrator appointed in accordance with such rules. The language of the arbitration shall be English, and the seat of arbitration shall be Dubai, United Arab Emirates.
